This Privacy Policy explains how Segistics LLC (“Segistics,” “GiveBid,” “we,” “our,” or “us”), which operates the GiveBid online charitable and fundraising auction marketplace — including the GiveBid website at givebid.com and the GiveBid mobile application (collectively, the “Services”) — collects, uses, and shares personal information. Segistics is the party responsible for the personal information collected through the Services.
This Policy applies to bidders, registrants, and visitors who use the Services, and to the individuals who set up or represent the independent sellers on the marketplace (“Auction Hosts”). The business relationship between Segistics and an Auction Host is governed by a separate seller agreement, under which Auction Hosts are contractually required to handle bidder personal information in accordance with this Policy and applicable law.
GiveBid is intended solely for users located in the United States. By using the Services, you agree to the collection and use of personal information as described in this Privacy Policy, which is incorporated into, and is subject to, the GiveBid Terms of Use and the GiveBid App Terms & Conditions.
GiveBid is a technology platform. Auctions are offered by independent Auction Hosts, and each Auction Host is the seller and merchant of record for its own auctions. Payments are processed through a third-party payment processor; we do not request, hold, or handle bidders’ funds. This Policy describes our own practices; Auction Hosts and the payment processor maintain their own practices, and their handling of information is governed by their own terms and policies.
Information We Collect
Information you provide to us. When you create an account, place bids, contact us, or otherwise use the Services, you may provide your name, email address, telephone number, password, billing and shipping address, bidding and purchase activity, and the contents of your communications with us. If you register as, or on behalf of, an Auction Host, you may also provide business and identity information and tax and payout details, much of which is collected and verified directly by our payment processor. When you enter payment details to bid or pay, those details (such as your payment card number) are collected and processed by the payment processor (Stripe); we do not store full payment card numbers.
Information we collect automatically. When you use the Services, we and our service providers may automatically collect device and usage information, including your IP address, device type and identifiers, operating system and browser type, app version, the pages or screens you view, the actions you take, referring and exit pages, and the dates and times of your activity. We also collect location information, including your general location inferred from your IP address and, where you grant permission, more precise location from your device, which we use to operate, optimize, and personalize your experience.
Information from third parties. We may receive information about you from Auction Hosts, our payment processor, analytics providers, and other service providers in connection with operating the Services and completing the transactions you initiate.
Cookies and Tracking Technologies
We and our service providers use cookies, software development kits (SDKs), pixels, device identifiers, and similar technologies to operate, secure, and improve the Services. These technologies generally fall into the following categories:
• Essential technologies, which are necessary for the Services to function, such as keeping you logged in and maintaining the security of your session.
• Performance and analytics technologies, which help us understand how the Services are used so we can improve them.
• Functional technologies, which remember your preferences and settings.
We do not use these technologies to track you across other companies’ apps or websites for advertising. You can control cookies through your browser settings and control device identifiers through your device settings, as described in the “Tracking and Your Choices” section below. Because there is no common industry standard for how to respond, we do not currently respond to browser “Do Not Track” signals.
How We Use Information
We use the information we collect to:
• operate, provide, and maintain the Services and the GiveBid marketplace;
• create and manage your account and authenticate you;
• facilitate bidding and process the transactions you initiate through our payment processor;
• communicate with you, including transactional messages and, where permitted, marketing communications from us and our affiliates that you can opt out of;
• personalize and improve the Services and perform analytics;
• detect, investigate, and prevent fraud, abuse, and security incidents; and
• comply with our legal, tax, and regulatory obligations and enforce our agreements.
How We Share Information
Auction Hosts. When you place or win a bid, we share the information necessary to complete and fulfill that transaction with the applicable Auction Host, which may include your name, contact information, and shipping address. Under their seller agreement, Auction Hosts are contractually required to handle your information in accordance with this Privacy Policy and applicable law. Where an Auction Host is, or represents, a charitable organization, your transaction information may be shared with it as part of completing and fulfilling the transaction.
Payment processor. Payment information is provided to and processed by our third-party payment processor, Stripe, to complete transactions, including with the Auction Host as the merchant of record for the applicable auction. We do not store full payment card numbers.
Service providers. We share information with vendors that perform services on our behalf, such as hosting, analytics, customer support, and communications, subject to obligations to protect the information and to use it only to provide services to us.
Affiliates. We may share information with our affiliates — entities that control, are controlled by, or are under common control with Segistics — who may use it consistent with this Policy, including to provide and market relevant services to you.
Legal and safety. We may disclose information where we believe it is necessary to comply with law or legal process, to enforce our agreements, or to protect the rights, property, or safety of GiveBid, our users, or others.
Business transfers. We may disclose or transfer information in connection with a merger, acquisition, financing, or sale of all or part of our business.
With your direction or consent. We may share information at your direction or with your consent. We do not sell your personal information, and we do not share your personal information with third parties for cross-context behavioral advertising or targeted advertising.
Tracking and Your Choices
Marketing communications. You can opt out of marketing emails using the unsubscribe link in those messages, and you can stop SMS messages by replying STOP. You may still receive non-promotional, transactional messages about your account and your transactions.
Push notifications. You can disable push notifications through your device settings.
Location. You can enable or disable location access for the App through your device settings; if you disable it, some features that rely on location may not work properly.
Cookies. You can manage or disable cookies through your browser settings, though some features may not work properly without them.
Advertising and cross-app tracking. We do not track you across other companies’ apps or websites for advertising, and we do not share your information with advertising networks. You can still reset or limit your device’s advertising identifier through your device’s privacy settings on both iOS and Android.
Accessing and updating your information. You can review and update your account information by logging into your account or by contacting us.
Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Policy and to comply with our legal, tax, accounting, and regulatory obligations, resolve disputes, and establish, exercise, or defend legal claims. Retention periods vary by the type of information and the purpose for which it is held; in general:
• Account and profile information is retained for as long as your account is active and, after your account is closed, for up to seven (7) years — and longer where a longer period is required by law or where the information relates to an actual or anticipated dispute.
• Transaction, bidding, order, and payment-related records are retained for at least seven (7) years to meet tax, accounting, and financial-reporting obligations.
• Communications with us, such as support requests, are retained for up to five (5) years.
• Device, usage, log, and location information is retained for up to twenty-four (24) months, and longer where necessary for security, fraud prevention, or investigation.
• Records reflecting your marketing choices, including opt-out and suppression records, are retained for as long as necessary to honor your preferences. When personal information is no longer needed for these purposes, we delete or de-identify it.
Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a security incident affects your personal information, we will notify you and the appropriate authorities as required by applicable law.
Children’s Privacy
The Services are intended for users who are at least 18 years old and are not directed to children. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will take steps to delete it.
Your U.S. State Privacy Rights
Depending on your state of residence, you may have rights regarding your personal information, which may include the right to know about and access the personal information we collect, to request its correction or deletion, and to opt out of the “sale” or “sharing” of personal information or of targeted advertising. We will not discriminate against you for exercising these rights.
California. California residents may request the categories and specific pieces of personal information we have collected, the categories of sources, the business or commercial purposes for collecting it, and the categories of third parties with whom we share it, and may request deletion or correction, subject to
legal exceptions. Because we do not sell or share personal information for cross-context behavioral advertising (as those terms are defined under California law), we do not offer a “Do Not Sell or Share My Personal Information” option; your other rights remain available. You may use an authorized agent to
submit a request on your behalf.

Third-Party Services and Links
The Services may contain links to, or interact with, third-party websites and services, including Auction Hosts and our payment processor. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies.
Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date above, and your continued use of the Services after the changes take effect constitutes your acceptance of the updated Policy.
